[Note from Steve: This post continues a series of posts, bipartisan in spirit, that analyze the mistakes the “Founding Fathers” made in writing the Constitution, that revered “law of the land.” Why are these errors so meaningful now? Because America’s fascists have discovered them and are using them to destroy American democracy!]
The amendments to the US Constitution, especially the Bill of Rights, offer all the evidence anyone needs to conclude that the Founding Fathers failed in their original plans but also were also willing to recognize their errors and try to correct their mistakes. So much for the “originalism” our fascist SCOTUS judges often champion to justify their fascist junta-like decisions, including making Donald Jackass Trump essentially a king. Since the time of the Founding Fathers, there has occurred an uproar among those who weren’t fascist aristocrats that led to including important rights like freedom of religion (they should have also included “freedom from religion”), freedom of the press, and so forth.
Errors were often also made in language. No US citizen has an absolute right to bear arms, for example. The Founding Fathers were obviously thinking about militias when they wrote that Second Amendment (the colonial militias became our national guard groups), not individuals, because militias played such an important role in defeating the British in the Revolutionary War. I’m sure they would have been aghast watching Donald Jackass Trump’s attempted coup on January 6, 2021, would consider the Oath Keepers and Proud Boys to be groups of violent terrorists and not valid militias, and certainly would have considered those actions treason deserving a punishment meted out by a firing squad .
Other amendments were sloppily written by the Founding Fathers and many others of questionable legal competence who now include our current fascist SCOTUS’s flawed interpretations of the language used. Consider the Fourteenth Amendment that the “f&^%ing moron” Donald Trump continues to lie about (sorry, you jackass, there are many countries besides the US that have birthright citizenship!), and he can in no way overturn that amendment with executive action, no matter how much power our damn fascist SCOTUS judges have given him.
The Electoral Count Act of 1887, amended in 2022, provides yet another example; it laid out how the Twelfth Amendment should be applied. Narcissus le Grand tried to change that in an obvious illegal and unconstitutional action that led up to his attempted coup. The Twenty-Fifth Amendment could have been used to declare this wannabe fascist dictator who was willing to stage a coup mentally incompetent and unfit for office instead of impeaching him for his actions…or both could have been applied. (VP Pence only went so far, so he’s just a half-assed hero! No surprise there.)
In brief, from the Founding Fathers on, unclear language and aristocratic or fascist-leaning interpretations (the Roe v. Wade decision by SCOTUS was yet another abuse of power!) have taken our democracy to the brink of fascism’s dangerous precipice. We could soon fall into that hellish chasm. Fixing things would require a will that no one seems to have, so the fascists will probably be successful in their plans to destroy American democracy!
This article ends my sad tales about how the Founding Fathers royally fucked us over. There are of course others to be told. No legal document is perfect, but fascist elements in our society have discovered how to use these errors present in the Constitution and its amendments to further their nefarious schemes. Trump is just the instigator, the “fucking moron”: He expects other fascists to do what they’re told. They did it during his first term; they’re busily doing it now. The only remedy might be another American Revolution, a civil war to remove the blight of fascism destroying America and the world. The future of human beings on planet Earth is in peril, and the crippling and lethal pandemic now is fascism.
Patriots must unite against this common enemy! Treasonous SOBs out to destroy democracy in America must pay for their crimes!
